Standard Terms & Conditions

 

All below terms and conditions are applicable to bookings made directly with Kutwelo Ltd. T/A Kutwelo - Luxury Africa Travel, hereinafter referred to as 'Kutwelo - Luxury Africa Travel'.

By making any booking, you agree to comply with and be bound by these Terms and Conditions. 

These Terms and Conditions apply to any bookings you make with us in person, over the phone or by email. We will rely on the authority of the person making the booking to act on behalf of any other traveller on the booking (regardless of whether other travellers have made separate payments) and that person will bind all such travellers to these Terms and Conditions.

 

Quotation and Costs

 

All quotations are based on anticipated costs and are subject to amendment should these anticipated costs increase due to circumstances beyond control of Kutwelo - Luxury Africa Travel.
Provisional reservations are held for 10 days from date of quotation. A provisional booking is confirmed on payment of deposit. Should the necessary deposit not be paid within the 10 days then the provisional booking is cancelled.

Kutwelo - Luxury Africa Travel is under no obligation to give a breakdown of costs on any booking.

 

Deposit and Payments

 

Bookings are confirmed with the payment of a non-refundable deposit of 30% of the total itinerary cost. 

Airline reservations require 100% of the total booking value to be paid on date of confirmation. 

Upon receipt of the paid deposit, we will confirm your arrangements in writing to you. 

Upon our confirmation, your booking is considered confirmed, and subject to the governing terms and conditions. 

The balance of your reservation is payable in full no later than 75 days before arrival date.

Deposit and payment requirements might differ depending on specialist product and or seasonality.

 

Cancellations

 

After the booking has been confirmed, should you wish to cancel the services held on your behalf the
following cancellation schedule applies:

- More than 75 days before arrival, 30% of the reservation full value will be forfeited.

- Less than 75 days before arrival and No Shows - 100% of the reservation’s full value is forfeited.

Postponements, changes, amendments and cancellations are only effective on receipt of written notification. 

Cancellation fees may differ due to specialist product and / or peak season travel. Airline reservations are 100% non-refundable.

 

Postponements

 

Postponements are treated individually where we will endeavour to find the best possible solution for our clients. 

It is possible that postponements will be considered the same as a cancellation.

 

Financial Arrangements

 

We receive remuneration through commissions, financial incentives and other means (together, “financial arrangements”) from booking travel and travel-related products and services on your behalf with third party travel service providers. We are not required by law to disclose to you the nature or value of these financial arrangements.

 

Travel Insurance

 

It is a condition of booking, that the sole responsibility lies with you to ensure that you carry the correct comprehensive travel and medical insurance (including cover for pandemic related occurrences) to cover yourself, as well as any dependents/travelling companions. This insurance should include cover in respect of, but not limited to, the following eventualities: cancellation or curtailment of flights booked and travel arrangements made, emergency evacuation expenses, medical expenses, repatriation expenses, damage/theft/loss of personal baggage, money and goods. Kutwelo - Luxury Africa Travel, their representatives, employees and agents will take no responsibility for any costs, losses incurred or suffered by you, or your dependents or travelling companions, with regards to, but not limited to, any of the above mentioned events.

You will be charged directly by the relevant service providers for any emergency services you may require 

and may find yourselves in a position unable to access such services should you not be carrying the relevant insurance cover.

We suggest Global Rescue - our travel safe partner. Upgrading to cover any cancellation reason is highly recommended.

 

Passports & Visas

 

A valid passport is required for all international destinations. Please note that you are responsible for obtaining the required documentation and or visas applicable for entry. Passports must be valid for six (6) months after the return of your journey and should also have sufficient blank pages for visas and immigration stamps. 

Travel to South Africa requires you to have a minimum of two blank pages in your passport for visas and immigration stamps. 

Kutwelo - Luxury Africa Travel cannot be held responsible should you be denied entry to a country due to non-compliance with these requirements.

Kutwelo - Luxury Africa Travel will require a copy of a valid passport to be submitted in order to confirm reservations on all services made.

Liability

 

Kutwelo - Luxury Africa Travel its employees, shareholders, officers, directors, successors, and agents purchase transportation (by aircraft, coach, train, vessel or otherwise), hotel and other lodging accommodations, restaurant, ground handling and other services from various independent suppliers. All such persons and entities are independent contractors. As a result, Kutwelo - Luxury Africa Travel is not liable for any negligent or wilful act of any such person or entity or of any third person. In addition and without limitation, Kutwelo - Luxury Africa Travel is not responsible for any injury, financial or physical loss, death, inconvenience, delay or damage to personal property in connection with the provision of any goods or services whether resulting from but not limited to acts of God or force majeure, illness, disease, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of aircraft or other means of transportation or for failure of any transportation mechanism to arrive or depart on time. Under circumstances where our liability cannot be excluded and where liability may be lawfully limited, such liability is limited to the remedies required of us under applicable law (including the Consumer Guarantees Act). This liability clause is subject to your rights under the Consumer Guarantees Act and nothing in these Booking Terms and Conditions is intended to limit any rights you may have under the Consumer Guarantees Act or the Fair Trading Act.

 

There are many inherent risks in experiential travel of the type involved here, which can lead to illness, injury, or even death. These risks are increased by the fact that these experiences take place in remote locations, far from medical facilities. Passenger assumes all such risks associated with participating in these experiences

 

Supplier Insolvency

 

Without limiting the above Liability, for the avoidance of doubt, in the event of a third party provider being unable to provide you with the product or service you have booked due to that third party provider becoming insolvent or being placed under external administration, subject to your refund and remedy rights under the Consumer Guarantees Act, we have no obligation to reimburse you for the cost of your booking, or for any loss or damage you may otherwise suffer as a result of any such insolvency or external administration.

 

Governing Law

 

If any dispute arises between you and us, the laws of New Zealand will apply. You irrevocably and unconditionally submit to the 

exclusive jurisdiction of the courts of New Zealand, and waive any right that you may have to object to an action being brought in those courts.

 

Privacy Policy

 

Kutwelo - Luxury Africa Travel shall take all reasonable steps to protect your personal information.

In particular, you agree that in certain circumstances (such as where you request us to book international travel for you), we are permitted to disclose your personal information to overseas recipients. Such recipients may include the overseas travel service providers (e.g. airlines, accommodation or tour providers) with whom you make a booking. These travel service providers will in most cases receive your personal information in the country in which they will provide the services to you or in which their business is based.

Generally, we will only disclose your personal information to these entities and/or persons in connection with the facilitation of your travel booking and/or to enable the performance of administrative and technical services by them on our behalf. Where we disclose your personal information to any entity and/or person (including any overseas recipients), you agree that: (i) in the case of travel service providers or other recipients who are providing services directly to you, we will not be required to ensure that recipient’s compliance with New Zealand privacy laws or otherwise be accountable for how they handle your personal information and you acknowledge and agree that your rights in relation to their handling of your personal information are governed by the contract between you and that recipient (which may include their privacy policy); and (ii) in the case of our related entities and travel service providers who perform services for us, we will take reasonable steps to ensure that recipient’s compliance with New Zealand privacy laws. When used above, “disclose” includes to transfer, share, send, or otherwise make available or accessible to another person and/or entity.

 

Modifications/Variations

 

Kutwelo - Luxury Africa Travel may, in its sole discretion, change this agreement or any part thereof at any time without notice.

 

Acknowledgement

 

You acknowledge, understand and agree to the above terms and conditions. These terms have been updated as of 1 April 2024.
